Terms Conditions & Privacy Policy

General Condition

Midland Games provide the following terms and conditions for hire and sale which form the basis of any transaction/booking entered into and it is assumed that the customer has read and agrees with these conditions. We would request that in the event of the customer not being able to adhere to these conditions that we are notified at the quotation stage of the booking process. Conditions where a conflict may occur include delivery restrictions, additional administrative requirements prior to or at the point of delivery and, specifically, where the customer is unable make full payment prior to the event or payment of the required deposit when booking.  

Terms of Sale

1/ Midland Games Ltd shall retain ownership of all merchandise until cleared payment has been received

2/ Where specified new products have a 12 months 'back to base' warranty covering electrical and mechanical breakdown.

a) The warranty excludes wear and tear, accidental damage and any damage due to neglect and misuse.

(b) It is the customers responsibility to arrange for the return and for carriage costs to Midland Games Ltd.and for the costs incurred in the return to the customer. 

3/ Under no circumstances will Midland Games Ltd be responsible for any consequential loss due to failure of any game.


Terms of Hire


The Customer;  The individual, Company or Organisation making the booking

            Our Company; Midland Games Ltd


1/ We can accept bookings in writing, by telephone or via email. If we have agreed to accept your booking by any of the above methods, a contract has been entered into and full terms and conditions apply from the time your booking is accepted. This applies irrespective of whether any deposit has been sent or received. Full terms of hire apply regardless of whether any hire agreement has been signed. 

2/ When a booking is made it is assumed that the customer has read, understands and fully agrees to the terms and conditions of hire.

3/ All deposits are non refundable. Notwithstanding this, our cancellation policy is as stated in condition 4/ below, unless agreed previously, in writing, at the time of booking. 

4/ Cancellation Policy:   

In the event of a booking being made by any method shown in condition 1/ above and subsequently being cancelled the following cancellation terms apply. This policy does not apply to re-sheduled or amended bookings. Where we have agreed to reshedule an event, which is subsequently cancelled, the full hire fee will be payable. Where a booking is amended resulting in a reduced hire fee, Midland Games Ltd reserve the right to charge a cancellation fee (as per our standard cancellation policy) on the difference between the original and revised hire fees. 

  • An amount of 25% of the hire amount shall be payable if the event is cancelled 45 days or more before the event.
  •  In the event of cancellation 28-45 days before the event, 50% of the full hire  amount shall  be payable.
  •  In the event of cancellation within 28 days of the event the full hire amount shall be  payable.

5/ Bookings are non-transferable

6/ Payments can be made by BACS, cheque or cash. We require either full payment or a 25% deposit at the time of booking with the balance payable not later than 28 days prior to the event. 

7/ Where hire  products have been booked for outdoor use and the event cannot proceed due to unsuitable weather conditions (ie high winds and/or heavy rain) we will provide (subject to availability) substitute alternative indoor hire items.

8/ Please note that in the event of wet or windy weather conditions Midland Games Ltd reserve the right to cancel any event, particularly if we feel that there is an increased risk of injury to the users of the hire equipment or Midland Games Ltd staff and/or damage to the hire equipment.

9/ Where it has been agreed at the time of booking and the booking has been accepted on the basis that the customer will provide an indoor facility in the event of wet/windy weather, we reserve the right the right to cancel the booking without refund where this is not available/provided on the day of hire. In the above circumstances if we do agree to site the equipment outdoors in wet weather we may charge a cleaning/drying off fee.  


Accepted Methods of Payment

  • Bank transfer (BACS)
  • Cheques (Subject to clearance prior to the event)
  • Cash. 

Delivery and Collection

1/ Arrangements for delivery and collection will be agreed at the time of booking. Details of the space required for each item is provided on the website and will be discussed/agreed at the time of booking. Where a power supply is required, the customer should ensure that one is available upon delivery/set up.

2/ It is the customers responsibility to ensure that satisfactory arrangements are in place to facilitate delivery and collection. For some of our larger items we will need to park on the site, at the point of set up. For all other hire products we need a clear width of at least three feet (ie a 3ft entrance and clear access to the site) We should also be made aware of any potential difficulties/hazards, including lack of vehicular access, lack of space, excessive walking distances, staircases or obstacles. We also need to be made aware of any uneven or sloping surfaces, overhanging trees/lights/other and the type of surface the equipment is to be placed on (ie grass, concrete etc.)  

3/ All costs incurred by Midland Games Ltd during delivery and collection as a result of unsatisfactory vehicular access or lack of parking facilities will be reimbursed by the customer to Midland Games Ltd. These may include parking charges, parking fines and wheel clamping release fees.

4/ Should we be unable to deliver the hire equipment due to lack of vehicular access, obstructions, lack of space, an unsuitable site or the need to carry the hire equipment an unreasonable distance the full hire fee shall still be payable. In the event of delay caused by the above factors we reserve the right to charge an additional hire fee.  

5/ If it is felt that the proposed site is unsuitable, creates a danger for users or potential for damage to the equipment we reserve the right to refuse delivery. In this event the full hire fee shall still be payable.

6/ Should we be delayed in the collection of the equipment due to the above reasons in (3) or the event continuing after the agreed finish time ,we reserve the right to charge a pro rata fee for any delay.

7/ In the event of us not being able to deliver the hire equipment for any reason our maximum liability will be for the hire fee in whole or in part and we will not be responsible for any consequential loss due to non delivery or delayed start. This includes any event which we may cancel due to wet or/and windy weather conditions.

8/ If we are delayed or unable to deliver due to circumstances beyond our control (ie traffic hold ups, or road closures due to accidents, flood or snow) we will compensate the hirer, in part or in full, by way of a credit note based upon the hire time lost due to the delay or cancellation.

9/ Inflatables are powered by inflation fans.  We will normally use extention leads to the mains electricity supply at the venue. We will need to establish a power source at the time of booking  ie whether there will be a suitable mains power supply.  

Hire Equipment

1/ Hire equipment may vary slightly from that shown on our website and any measurements and specifications are approximate. It may be necessary to substitute hire equipment with similar goods in the event of loss of or damage to the hire equipment prior to the booking.

2/ An agreement will be issued, prior to your event, outlining the clients obligations in respect of the care of the equipment and we will require.a signed copy prior to the games being used. The customer is responsible for any damage, loss or theft of equipment whilst on hire. Any damage to the equipment caused by misuse or neglect, or loss due to theft, shall deem the hirer paying for the loss, repair and any resultant loss of business.These conditions also apply in relation to the hire items becoming dirty during use, they should be in the same condition upon collection as when they were delivered.

3/ On some occasions we will charge the customer a loss/damage deposit to cover small losses. The customer is responsible for all damage/losses whilst on hire. In the event of any loss/damage, the customer will be liable for any costs exceeding  the damage deposit paid,up to and including the full cost of damage/loss.  

4/ Instructions will be issued detailing safety instructions and must be adhered to at all times. It is the hirer's responsibility to ensure the equipment is properly supervised in such away to prevent any injuries.

5/ If we are delayed and cannot collect the hire equipment at the time agreed, the equipment should not be left unattended. The customer is responsible for the hire equipment from the time of delivery up until the time it is collected.

6/ The hire equipment will be safely sited upon delivery and should not be moved or interfered with, unless previously agreed. Please ensure that at the end of your event all games and parts are present and accounted for and available for collection. 

7/ In the event of improper use of the hire equipment deemed likely to cause personal injury or damage to the hire equipment we reserve the right to terminate the use of the hire equipment without recompense.
8/ It is the responsibility of the customer to ensure that all users are aware of the conditions related to the safe and proper use of the equipment. In the event of misuse of the equipment we reserve the right to terminate the hire without refund.

9/ In the event of abusive or aggressive behaviour towards operating staff we reserve the right to terminate the hire immediately without refund.

10/ Whilst every effort is made to ensure hire equipment is clean and dry when delivered, it may be necessary to dry off items on site. For instance, where we have collected equipment in rain/wet weather and have not had an opportunity to dry it off prior to the next delivery/hire.  

Liability for property damage, injury & Insurance

1/ It is the customers responsibility to make us aware at the time of booking of any insurance arrangements that they may require.

2/ It is essential that these requirements are established at the time of booking as additional costs may be involved for arranging the appropriate insurance covers.

3/ Where the equipment is being supervised by the customer, it is the customers responsibility to arrange insurance if so required.

4/ Where the equipment is being supervised by Midland Games, insurance is normally provided.

5/ Our Company will not accept any liability for personal injury caused during the use of the hired equipment.

6/ Our Company will not accept any liability for any loss off or damage to any property arising from the hire of the equipment, including damage to underground services.

Privacy Policy

1/ Midland Games Ltd receives emails, enquiry forms and information by telephone from customers. We use this information in order to provide quotations, information and guidance on the hire and purchase of our products.

2/ We store information, as above, in order to service current and future enquiries. This information includes names, addresses, telephone numbers and email addresses necessary to provide quotations and guidance to our customers.

3/ We retain invoices and personal information in order to comply with HMRC, accountancy & other regulatory requirements. We normally keep this information for a minimum of 6 years.

4/ We do not use the above information for marketing purposes, unless specifically requested to do so. If you have agreed to receive marketing information (ie on new products) you can choose to change this at any time, by emailing us at enquiries@midlandgames.co.uk .

5/ We will provide a copy of the information we hold on clients or suppliers in relation to ‘subject access requests‘ at no cost, when requested to do so and amend any personal information which is incorrect or incomplete. Contact us at enquiries@midlandgames.co.uk .

6/ We will delete information from our records when requested to do so. This excludes invoices and other documents we need to keep for accounting and legal purposes.

7/ We do not sell or provide customers information and data to third parties for marketing purposes.
